Parties Responsibilities
Ava Living has created Ava’s
Social eCommerce Program for exclusive use by Participating Designers on Avaliving.com
to further their marketing efforts for their own design practices. Ava Living will not be construed to be a partner, officer or in any way responsible for Participating Designers’ business activities.
Ava Living’s responsibilities: Ava Living is providing the website, collection and disbursement of funds for the Online Designer Services.
Ava Living does not guarantee the merchantability of the software, the
financial disposition of the consumers, and does not make any
guarantees or warrant that Designer will be able to obtain any leads or
any business or sell any Online Designer Services.
Participating Designer’s responsibilities: Participating
Designer will provide updates to their Ava Profile and portfolio, will
complete Designer Room Reviews and purchased Online Designer Services
within the turnaround times shown below, and is solely responsible for
the content, accuracy and quality of the content given by them to
Consumer. Participating Designer will be solely responsible for communicating directly with Consumer once the leads/requests are delivered to their Ava Profile.
Designer Services Pricing
Designers can set whatever prices they choose for their Online Designer Services. Designers must request changes to their service pricing by emailing support@avaliving.com whenever you wish to change. Service Pricing changes may take up to 48 hours to take effect.
Turnaround Times
Ava
Living has posted expected turnaround times for completion and delivery
of Online Designer Services, including Designer Room Reviews to
consumers. Participating Designers are expected to deliver completed Reviews and Premium Design Services within the turnaround time frames, or directly contact consumer to arrange other. The current Turnaround times 3
business days both for Designer Room Reviews; 2 business days for
Designer On-Demand; and 5 business days for Designer's Top 7, 3D Space
Plan, and Personal Shopping. These times are subject to change without prior notice.
If Participating Designer repeatedly misses turnaround times without
necessary contact with participating consumer, they may be asked to
exit this program.
Participation Fees
Membership into Ava’s
Social eCommerce Premium Program is $120 per year charged in advance to your
credit card every 365 days.
Revenue Sharing - Payment Received from Consumers
The revenue received for completed Online Designer Services will be shared at 70% to designers and 30% to Ava Living.
Ava Living will collect all funds from consumers, and will deposit
designer funds at month end for completed Online Designer Services into
your Pay Pal account. If you don’t yet have a Pay Pal account, you will have an opportunity to create one as part of the subscription process at PayPal. It’s free and takes only a few moments.
No Resale Of The Services
Your right to use the Services is personal to you. You agree not to resell the use of the Services.
Indemnification
You
agree to indemnify Ava Living and each of its licensors and service
providers from and against any and all liabilities, expenses (including
attorneys' fees) and damages arising out of claims based upon use of
your Ava Living account, including any violation of this Agreement by
you or any other person using your account, any claim of libel,
defamation, violation of rights of privacy or publicity, any loss of
service by other customers, any infringement of intellectual property
or other rights of any third parties, and any violation of any laws or
regulations prohibiting transmission of unsolicited faxes.
Modifications to Services
Ava
Living reserves the right to modify or discontinue any of the Services
with or without notice to you. Ava Living shall not be liable to you or
any third party should Ava Living exercise its right to modify or
discontinue the Services.
Termination
Either
you or Ava Living may terminate your participation in the Designer Room
Review program, with or without cause, upon notice. Termination
requested by you will take effect at the end of your current billing
cycle. All termination requests must be submitted via email to support@avaliving.com or via telephone at (562) 435-3242. Ava
Living also reserves the right to terminate or suspend your
participation in Designer Room Review without prior notice, provided
that Ava Living will attempt to confirm such termination or suspension
by subsequent notice.
